Draft law criminalising instant triple talaq approved, Muslim bodies say not consulted

The Muslim Personal Law (Shariat) Application Act, 1937, allows Indian Muslims to be governed by the Shariat. He merely said many state governments, to whom the draft of the bill was sent, had supported the Bill. He added the current laws are enough to provide remedies to Muslim women.

She believes that the introduction of the bill that makes instant talaq a non cognisable offence with provision of imprisonment will help further reduce such cases.

Owaisi demanded that the government hold consultation with All India Muslim Personal Law Board (AIMPLB) on the bill as it was the main party in the batch of writ petitions filed in the Supreme Court on triple talaq.

The bill termed as the "Muslim Women (Protection of Rights on Marriage) Bill, 2017" seeks to criminalise the practice of instant divorce in Islam.

"Cabinet has taken historic decisions today which will have a long-term impact in the growth of the country. because Parliament session is on, I can not give details of the Bill", Prasad said.




"This Bill is a beginning, but mere criminalisation of triple talaq is not the objective". We also want to stop the practice of triple talaq.

"In the process the Muslim women have been denied their Quranic rights as well as their constitutional rights as Indian citizens", said the letter to newly anointed Congress president.The letter pointed out that almost all Muslim countries in the world such as Morocco, Tunisia, Turkey, Egypt, Jordan and even Bangladesh and Pakistan have codified personal laws governing marriage and family matters, but Indian Muslim women continue to be denied the protection of law. This is a serious issue which must be dealt seriously as many women are affected by the triple talaq.

The Congress is in the forefront of gender justice, progressive laws, and supported the stoppage of triple talaq, he said. It remains to be seen what is the fate of the bill in the parliament.

"The community is indulging in argument but that doesn't mean we will give up our constitutional and legal entitlement".

The bill is expected to be introduced during the Winter Session of Parliament that commenced on Friday. It is not the matter of BJP, Congress or any other political parties. The passing of bill and implementation of it will set the future discourse of the triple talaq.
