"Values are inculcated in a broad social and political culture and patriotism can not be inculcated among people by Supreme Court order making it mandatory for playing National Anthem in cinema halls", he said. The Supreme Court observed that the government can bring in a regulation or ordinance in this regard on the basis of its stand.

The apex court asked the Centre to consider amending the rules for regulating playing of the national anthem in the theatres ahead of the start of the film. The court said that the center should not be influenced by any of the earlier orders or current observations of the Supreme Court in this matter.

The court then told attorney general K.K. Venugopal that the Centre should take a call on amending the Prevention of Insults to National Honour Act (Flag Code), which governs the playing the national anthem in public places and on certain occasions.




Justice Chandrachud was part of a three-judge Bench led by Chief Justice of India Dipak Misra hearing a petition filed by Kodungalloor Film Society in Kerala to recall the November order.

"Should we wear our patriotism on our sleeves?". Finally, the court left it to the discretion of the government to bring out any notification, if necessary, to take a call to make or not make the playing of the National Anthem mandatory in cinema halls, uninfluenced by the Court's earlier order. "Where this moral policing would stop?", Justice Chandrachud said. The court said that it was fundamental duty of every citizen to respect National Anthem and National Flag and it was desirable that anthem was played in public events but judiciary should not step in to make it mandatory in cinema halls. "People go to cinema halls for undiluted entertainment and they definitely need entertainment, not moral policing". These are all matters of entertainment. "They are not less patriotic", Justice Chandrachud added. Why people should assume that everyone who don't sing or stand for the national anthem is not patriotic.

Venugopal said, "the court has ample power under Article 142 of the Constitution to issue directions". He wanted both the laws should be in consonance to each other and disrespect should be made a punishable offence.
